1. Introduction
These Terms & Conditions govern the use of this website and the purchase of digital services provided by Hublum, a sole trader registered in England and Wales (“we”, “us”, “our”).
By placing an order on this website, you agree to be legally bound by these Terms.
If you do not agree, you must not use our services.
2. Nature of the Service
2.1 We provide a remote digital file modification service for BMW / MINI vehicles.
2.2 The service consists of editing a customer-supplied backup file (.BUP) and returning a modified file based on the customer’s request.
2.3 We do not physically access, repair, inspect, or modify the customer’s vehicle.
2.4 The customer is solely responsible for performing the read and write process on their vehicle.
3. Customer Responsibilities
By purchasing our service, you confirm that:
You are the legal owner of the vehicle or have permission from the legal owner
You understand that vehicle software modification carries inherent risks
You will follow all provided instructions carefully
You will ensure stable battery voltage during the write-back process
You will use compatible hardware (e.g., ENET or ICOM interface)
We are not responsible for damage caused by:
Power loss during programming
Interrupted write process
Incorrect software usage
Previously modified or corrupted vehicle software
Hardware, cable, or interface faults
Pre-existing vehicle faults
4. Compatibility & Technical Limitations
4.1 Not all features are available for all BMW / MINI models.
4.2 Function availability depends on vehicle specification, software version, region, and hardware configuration.
4.3 Some vehicles may contain manufacturer security protections that prevent certain modifications.
4.4 If a requested modification is not technically possible, we will inform you.
The service is provided “as is” without any guarantees of specific results or feature availability.
5. Digital Service & 14-Day Cancellation Waiver
5.1 Digital Nature of the Service
Our services are digital and custom-made, performed specifically according to the customer’s request.
No physical goods are supplied.
5.2 Right to Cancel (UK Consumer Contracts Regulations 2013)
Under the UK Consumer Contracts Regulations 2013, consumers normally have a 14-day cooling-off period for distance purchases.
However, this right does not apply once:
The customer has expressly requested immediate performance of a digital service; and
The customer acknowledges that their right to cancel will be lost once the service begins.
5.3 Express Request & Loss of Cancellation Right
By placing an order and ticking the consent checkbox at checkout, you:
Expressly request that we begin performance of the digital service immediately after payment confirmation;
Acknowledge that once processing has begun, you lose your statutory 14-day right to cancel under the Consumer Contracts Regulations 2013;
Understand that processing begins when access to the digital tool is provided, or when your submitted file is analysed or modified.
Once processing has commenced, cancellation and refunds are no longer available.
6. Delivery
6.1 Modified files are delivered electronically via secure customer portal or email.
6.2 Standard processing time is up to 24 business hours unless otherwise stated.
6.3 We are not responsible for delays caused by:
Incorrect file uploads
Missing or inaccurate information
Customer-side technical issues
Technical failures outside our control
7. Refunds
Refunds are not available once processing has commenced.
Refunds are not available after delivery of the completed digital file.
Each case may be reviewed at our sole discretion.
8. Limitation of Liability
8.1 Our total liability shall not exceed the amount paid for the service.
8.2 We shall not be liable for:
Vehicle malfunction
Software corruption
Loss of vehicle functionality
Financial loss
Legal or regulatory consequences
Indirect or consequential damages
Nothing in these Terms limits liability where such limitation is unlawful under UK law.
9. Legal Compliance
The customer is responsible for ensuring that any modification complies with applicable local laws and regulations.
Some modifications may be intended for off-road, motorsport, or show use only.
10. Intellectual Property
All edited files, tools, methods, and proprietary modifications remain the intellectual property of Hublum.
Customers may not:
Resell modified files
Reverse engineer our work
Distribute our modifications commercially
11. Fraud & Chargebacks
Initiating a fraudulent chargeback after receiving a completed digital service may result in:
Immediate account suspension
Permanent service ban
Submission of technical evidence to the payment provider
Legal recovery action where appropriate
We retain secure service logs and transaction records.
12. Governing Law
These Terms are governed by the laws of England and Wales.
Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
13. Changes to These Terms
We reserve the right to update these Terms at any time.
The latest version will always be published on this page.
